Children’s Car Seat Laws

Every state has its own rules and regulations regarding the use of a child’s car seat. In California, all car seats have specific requirements that must be met. If these requirements are ignored or neglected, the child’s parents could receive a ticket, or they could be placing their child in a riskier position.

The following rules apply to car seats in California:

  • Children under the age of 8 (or shorter than 57”) are required to be properly secured in a child restraint system and placed in a rear seat.
  • Children under the age of 2 (less than 40 lbs., or under 40”) must be properly secured in a rear-facing child restraint system.
  • Children in rear-facing car seats are required to be placed in a rear seat if there is an active passenger air bag.
  • Violation of the child passenger safety law is a standard offense.
