The Mesothelioma Litigation Process

Step 1 –  Your attorney will need documents verifying that the patient has indeed been diagnosed with mesothelioma or another asbestos-related disease. This information is can be found in medical records, and more specifically, a pathology report.

Step 2 – An experienced asbestos lawyer from The Barnes Firm will meet with you, either at your home or at our offices, to discuss your legal options, and discover how you or your family member had been exposed to asbestos. Our attorneys want to hear your story. Every detail you can recall or gather could be important as we build your case.

Since symptoms of asbestos exposure can take decades to become problematic, we understand if you are uncertain of the exact dates and circumstances. Please remember, a consultation with an asbestos attorney is FREE, and you will not owe a fee unless we win your case.

Step 3 – If you decide to hire The Barnes Firm, we will begin assembling all of the information you were able to provide, and our legal team will begin an investigation that could uncover more evidence that would be useful in your claim. This includes tracking down the dates, times and places that you or a loved one had been exposed to asbestos fibers.

Throughout the investigation, we will remain in contact with you and regularly inform you of our progress. At some point, our asbestos attorney may need to review various asbestos products with you. This will help determine the kind of asbestos product that you or your family may have been exposed to.

Step 4 – Once we determine where a person was exposed to asbestos, our investigation will turn towards the corporations that were responsible for manufacturing the asbestos.

Step 5 – After our attorneys gather all the necessary evidence and information, we will need a deposition. This is a legal proceeding where you are asked to answer some questions under oath. These questions most are often regarding asbestos exposure and your medical condition.

Step 6 – The lawyers at The Barnes Firm will do everything they can to resolve your case as soon as possible, either by settlement or jury verdict. The timeframe for each case can be different depending on how many defendants are involved in the case and your specific circumstances.
