About Our Best Motorcycle Accident Lawyers In San Diego

If you’ve been hurt in a motorcycle accident that involved a truck or passenger vehicle, it’s likely that the injuries you’ve sustained are far worse than those of the opposite party. In fact, studies show that motorcyclists are four times more at risk for fatal injuries compared to drivers of trucks, SUVs, and automobiles. While California law does require its residents to wear a helmet regardless of age, choosing not to wear one significantly increases the chances of life-threatening head trauma to motorcyclists.

After a motorcycle accident, there’s so much to think about.

When will I return to work? How will I pay for my medical bills? Who’s at fault?

Luckily, our experienced San Diego motorcycle accident attorneys here at The Barnes Firm can help you answer those questions and more

The Barnes Firm is here to serving nearby areas: Solana Beach, Coronado, Del Mar, Encinitas, Poway, Carlsbad, Santee, La Mesa, Chula Vista, San Marcos, Oceanside, Vista, Lemon Grove, Spring Valley, Imperial Beach, El Cajon, and Escondido.

What To Know About Motorcycle Accidents

San Diego, California Motorcycle Law: How it Could Be Hurting You

While laws were made to protect us, some motorcycle specific laws in California don’t necessarily work in favor of cyclists. However, motorcycle drivers and their passengers do have the same rights as automobile drivers when it comes to initiating a personal injury claim when involved in an accident.

Our San Diego car accident lawyers at The Barnes Firm wanted to point out a few California laws that might be attributed to the sky-high motorcycle accident rates in our state.

Lane Splitting:

Lane-splitting is a motorcycle-specific traffic law. This allows motorcycle riders to cut in and out of traffic that is moving very slowly or stopped. Some look at lane-splitting as a safe practice because it keeps bikers from becoming sandwiched between two vehicles and from inhaling car exhaust. Others, however, feel lane-splitting is dangerous, as there is a higher chance of an avoidable collision if bikers were to just stay in line with traffic.

Lane Sharing:

Lane sharing offers cyclists the opportunity to share a lane with another motorcycle or passenger vehicle, going in the same direction. Lane sharing in California is limited to bigger roads (two lanes headed in the same direction) and is generally not allowed on smaller highways. Although it has been considered unsafe by the CA DMV, it is still legal.

The Barnes Law firm motorcycle and truck accident lawyers serving San Diego and its surrounding areas encourage all motorcyclists to use extreme caution when participating in any lane splitting or lane sharing on the road.

Motorcycle Accidents By the Numbers in San Diego, California

In 2017, California had a recorded 955,293 registered motorcycle riders in the state. Of that number, nearly 12,000 motorcycle accidents occurred that resulted in injury and almost 500 with at least one fatality.

According to the National Highway Traffic Safety Administration in 2016 there were approximately 548 motorcycle accident deaths. Of those 548 deaths, 5% of the motorists were not wearing a helmet, which was the exact cause of their death.

Although California carries universal helmet laws, where it is illegal for any person or passenger of a motorcycle to ride without a helmet, our San Diego motorcycle accident attorneys still see a high percentage of fatalities due to catastrophic head and brain injuries.
